State Of San Andreas Civil Rights

The following sections are subject to constant change as both state and federal law develop and evolve. It is the duty of the citizen to read and have an understanding of these rules and rights. It is also the duty of all sworn law enforcement officers and government officials to uphold and defend these rules and rights as they are set forth by the State of San Andreas.

Section 1 – Rights of The People

As a State within these United States, all citizens are afforded the same rights as they are written within the Constitution of The United States of America.

The following section outlines rules and regulations set forth by the State of San Andreas for the civilian population, in accordance with the U.S. Constitution and current Federal Law. 

1.1: Weapon Rights and Law

  1. Legal Weapons:
  • Citizens must have a license to purchase firearms from Ammu-nation, additionally, Ammu-Nation registers all firearms to the purchaser.
  • A weapon that is purchasable at any Ammu-Nation across the state of San Andreas is to be considered a legal weapon. 

    LEGAL Weapons are as follows:
  1. Pistol | 9mm
  2. Pistol MK2 | 9mm
  3. SNS Pistol | .45 ACP
  4. SNS Pistol MK2 | .45 ACP
  5. Knife
  6. Baseball Bat
  • Unregistered, Automatic, and non-serialized/homemade firearms and weapons are considered illegal within the state of San Andreas, possession of and/or use of these weapons will result in legal action.
  • The use of a firearm (discharging said firearm) outside of a firing range, or private property without the basis of defending oneself, and without injury to others, will be considered Negligent Discharge of a Firearm.
  1. Open Carry Law: 
  • Civilians who are legally licensed to own a firearm are authorized to open carry a Handgun (Pistol), so long as the Handgun is secured within a holster on the individual’s person. The handgun SHALL NOT be brandished in a citizen’s hands at any point, unless the citizen is actively engaging in self-defense of themselves, or is within an Ammu-Nation shooting range.
  • Civilians may also openly carry a hunting rifle in designated hunting zones, as described at the hunting lodge, or to transport the rifle from the hunting store/home to their personal vehicle. Civilians MAY NOT be openly carrying a hunting rifle within Los Santos City Limits, Sandy Shores Town Limits, Paleto Bay Town Limits, or Los Santos/Blaine County Government Facilities.
  • Civilians are required to either disarm, or have their weapon held by LEO while within the confines of government property/facilities.
  • When asked, civilians must provide proof of licensing to LEO while open carrying.
  1. Concealed Carry Law: 
  • Civilians who are legally licensed to own a firearm are authorized to conceal carry handguns within the State of San Andreas.
  • Civilians are required to either disarm, or have their weapon held by LEO while within the confines of government property/facilities.

1.2: Traffic/Motor Vehicle Law 

  1. License: All individuals driving in the State of San Andreas MUST have a valid license on their person at the time they are driving.
  1. Vehicle Requirements: To be a legal/roadworthy vehicle within the State of San Andreas, a vehicle MUST have all of the following:
  • Functioning, visible/Non-covered headlights and Tail lights
  • Visible rear license plate
  • Free of major damage. (Minor scratches are inconsequential)

Example 1 – Monster Trucks/Mining Company Dump-trucks are NOT road legal vehicles. 

Example 2 – Vehicles with cosmetic covered head/tail lights

  1. Proper Direction Of Travel: As in all states within the United States, it is the responsibility of the driver to maintain proper direction of travel on the RIGHT side of the roadway, and within the established road lines. Failure to do so may be considered Reckless Driving, and is a criminal offense. 
  1. Traffic Lights: All are to be treated as stop signs while on red. It is the responsibility of the driver to ensure that the intersection is clear of traffic prior to proceeding on a red light. 
  1. Speed limits within the state of San Andreas are as follows: 
  • 60 Miles Per Hour (MPH) while within the confines of the City of Los Santos or the following towns: Sandy Shores, Paleto Bay, Grapeseed, Harmony
  • 80 MPH On all San Andreas highways and freeways.
  1. Parking – 
  • No vehicle is authorized to park on any and all curbs marked with RED paint, as those are for emergency vehicles. Vehicles violating this are subject to impound or tow.
  • No vehicle is authorized to park in a location specifically declared as a “No Park” zone. These vehicles are subject to impound or tow.
  1. Hit And Run: If engaged in a Motor Vehicle Accident (MVA), it is the responsibility of the driver to remain on the scene of the incident, and to exchange information for damages, and contact emergency services for reporting, any injured parties, and accident clean up. Should individuals not remain on the scene of an accident, and an affected party wishes, the fleeing party can be subject to legal action.
  2. Street Racing: A person shall not engage in an un-sanctioned  motor vehicle speed contest on a highway or public roadway of any kind. This includes utilizing any public road throughout the state as a means for automotive racing as a sport and/or for material gain. Any individual who organizes or partakes in a motor vehicle speed contest will be subject to legal action. 
  1. Driving Under The Influence (DUI): At no point can a citizen legally operate a motor vehicle of any kind while under the influence of any form of alcohol, narcotic, weed, or any substance that may or will impair a driver’s good judgement. 
  1. Emergency Vehicle Exception: LEOs in Emergency vehicles may disregard traffic laws which include red lights and speed limits in the following situations:
  • When responding to an emergency with lights and sirens activated, 
  • Without lights and sirens activated when conducting surveillance,
  • Or in situations where LEOs are required to approach an area without being noticed.
  • LEOs in emergency vehicles may disregard parking laws in the following circumstances:
  1. If emergency lights are activated
  2. At any red curbs in the vicinity of Pillbox Hospital

1.3: Property Law

1.3.1 – Private Property: Any property owned by an individual that was purchased through legal means through a real-estate agent or authorized person to person transfer as documented by the State of San Andreas.

Businesses: Businesses are considered private property, unless it is owned by the State of San Andreas. The owner of said property has the right to have individuals trespassed, defend the property with reasonable force, and to deny services to individuals. Additionally, businesses are covered under the same search and seizure laws as covered under the 4th Amendment, and Section 2 of this document.

Homes/Residence: All homes, to include trailers and apartments, are considered private property. The home owner has the right to have individuals trespassed from their property, and defend the home with reasonable force. The same search and seizure laws as covered under the 4th Amendment, and Section 2 of this document apply to all homes/residencies. 

1.3.2 – Government Property/Facilities: Any property/facility identified by the State Of San Andreas as a facility for government administration. These facilities include police stations, hospitals, sheriff offices, city halls and courthouses. Masks ARE NOT allowed to be worn within active government facilities, and should be removed prior to entry, failure to do so will result in removal from the property. Loitering on these properties can result in removal from the property by employed personnel.

Safe Zones: Most active Government facilities are considered safe zones. ANY crime committed within the confines of the ‘Safe Zone’ property will be considered federal offenses, and will be addressed accordingly by federal law enforcement personnel. Active government facilities currently include: 

  • Mission Row Police Department (MRPD – LSPD)
  • Pillbox Hill Medical Center (PHMC – EMS)
  • Sandy Shores Sheriff’s Office (SSSO – BCSO)
  • Bolingbroke State Penitentiary (BSP – BCSO/State Of San Andreas)

Fort Zancudo Military Installation: Fort Zancudo is a restricted area for non-government personnel. As such, under federal provisions, Army/USMC Military Police and Air Force Security Forces have authorization to shoot unauthorized individuals on-site if they breach the Entry Control Points (ECPs) at Fort Zancudo. 

1.3.3 – Public Areas: Any area within the State of San Andreas that does not fit the above descriptions, or isn’t marked as private/controlled property. This includes roadways, parks, sidewalks, etc. As such, it is the duty of individuals to follow all laws and regulations as set by the federal government, and the State of San Andreas while within these areas, as failure to do so can and will result in legal action. 


1.3.4 – San Andreas Anti-Mask Law: When on public or government owned property face masks of any kind are NOT to be worn. If seen in a public space with a face mask on, a Law Enforcement Officer can use their discretion as to whether they detain and search the individual wearing the mask {Reference Section 2, Sub-Section 2.4, Paragraph 2}. If an individual wearing a mask refuses to take it off when asked by a Law Enforcement Officer, it can be considered disobeying a lawful order. It can be considered failure to identify, and disobeying a lawful order, if an individual refuses to both identify and de-mask themselves. 

1.4: Contraband/Illegal Items

Contraband: The following list is all items considered contraband and illegal to have any amount of in one’s possession. These items will be confiscated by law enforcement if found, regardless of the individual’s intentions with these items. 

1.4.1 – Controlled substances include:

  • Cocaine 
  • Heroin
  • Crack
  • XTC
  • Meth
  • Mescaline
  • Shrooms
  • LSD
  • Lean
  • Bricks of Marijuanna
  • Marijuanna is legal in the state of San Andreas in amounts of NO MORE than 10x Units without medical cards, and NO MORE 20x Units with a medical card issued by Pillbox Medical Center
  • Units of marijuanna include any combination of edibles, joints, baggies. 

1.4.1 – Illegal weapons include: 

Class 1: 

  • Any Ammu-nation purchasable firearm that is not registered to that individual, or if an individual is not licensed to own that firearm.

Class 2:

  • ANY Police Issued sidearm
  • ANY Sidearm above .45 ACP
  • Any Semi-Auto handgun that is chambered in .45 ACP or below that has a scratched serial number
  • ANY Shotgun (Pump or Double-Barrel)

Class 3: 

  • ANY Police Issued long gun
  • ANY Full-Auto Firearm 
  • Advanced Rifle
  • Assault Rifle
  • Assault Rifle MK2
  • Assault SMG
  • Bullpup Rifle
  • Assault Shotgun
  • Battle Rifle

1.4.3 – MISC Weapons/Items (Subject To Continuous Update)

  • Swords/Battle Axes
  • Any and All Police Equipment
  • Suppressors
  • Extended Magazines
  • RFID Disruptors
  • Lockpicks 

Section 2 – Powers of The State

Outlined in this section are the powers of the government agencies, namely law enforcement, employed by the State of San Andreas

2.0. Emergency Contact Numbers

Note: Abuse of emergency communications systems (i.e. false reporting, spam calling emergency lines, ect.), will result in legal action being taken against individuals when they are caught. 

  1. Emergency Medical Services:
  • /311 – Using this sends a message written by the individual in need of help straight to the MDT/Dispatch system of EMS Personnel ONLY. This is the preferred method of communication with EMS Personnel.
  • Business App – The business app will show when there is EMS personnel on duty, and through the app you will be able to verbally communicate with EMS personnel over the phone, or text them your location directly.
  1. Los Santos Police Dept./Blaine County Sheriff’s Office:
  • /911 – Using this sends a message written by the individual in need of assistance straight to the MDT/Dispatch system of Law Enforcement Personnel ONLY. This is the preferred method of communication for emergency calls requiring police response.
  • Business App – The business app will show when there is Law Enforcement personnel on duty from each department, and through the app you will be able to verbally communicate with Law Enforcement personnel over the phone, or text them your location directly. This method is ideal for official, non-emergency communications. 

2.1. Police Powers

  1. When issuing an order or command to an individual, the Law Enforcement Officer (LEO) must announce themselves as a LEO and must be wearing uniform or a badge that shows they are an LEO within the State of San Andreas/United States. 
  1. When requested to do so by an individual, an LEO must:
  • Provide their name and badge number.
  • Request a supervisor who is on duty, If a supervisor is not on, then they may get another officer of equal rank to speak to the suspect.
  1. An LEO is required to remove any and all illegal firearms/items located on an individual that are discovered via a search during an investigation and appropriate steps will be taken to ensure the items are secured.
  1. Case Laws : The following link is to the main case laws that are taught to, and utilized by San Andreas law enforcement agencies. While all case law is applicable to LEO operations, these are the most prominent ones for San Andreas.
  1. Law Enforcement Officers have the authority to enter a business, regardless of owner’s consent, if they witness any criminal activity on the property or receive an actionable 911/Dispatch call from within the location itself. Officers will not have the authority to search the business unless they are executing a verified and signed search warrant.

2.2. Police Use of Force

  1. LEO’s may use less than lethal force in the following situations
  • An individual has refused to comply with a lawful order after numerous requests
  • If an individual is fleeing from a LEO and resisting arrest
  • If an individual is threatening the safety of other individuals within the immediate vicinity.
  1. LEOs may use lethal force in the following situations
  • When an armed individual poses a threat to any individuals within the vicinity. 
  • When an individual is known to be armed and dangerous, 
  • Who has recently caused serious bodily harm to another individual
  • A LEO has probable cause to believe that the individual poses a significant threat of death or serious bodily harm to any individual. 

2.3. Penalties:

  1. Based on rank, LEO’s may reduce charges/time at their discretion after a decent effort has been made to contact a lawyer.
  1. An individual may be held at Bolingbroke State Penitentiary if they are awaiting trial, if said individual has been charged at least 1 Capital Crime or a sworn in Judge has deemed the individual a risk to the people of Los Santos
  1. If an individual is charged with the same crime within 3 hours, a LEO may charge the individual double but is at their discretion.

2.4. Probable Cause:

  1. An LEO has the right to question an individual for the following:
  • A Weapons License if an individual is observed brandishing a firearm (weapon actively in hands of said individual)
  • A Weapons License if an individual is actively open carrying (Firearm is secured within a holster or on a sling, but is visible to the public.)
  • If an individual is found in the area of active drug selling activity.
  1. An LEO has the right to detain further and search for the following:
  • If an individual has been witnessed by LEOs to be participating in a drug deal, LEOs will have the right to search the individual and their owned vehicle or vehicle they have access to in the vicinity. 
  • An individual has committed a misdemeanor or felony crime.
  • An individual who has been witnessed by as LEO driving off road in any vehicle not designed to do so
  • An individual tests positive for GSR and is in the area of a 911 call reporting a shot fired or is in the area of a violent crime in which a firearm was used.
  • An individual who has been used as a hostage in a hostile or negotiation scenario.
  • An individual is observed to be intoxicated in a public place.
  • An individual has been witnessed by a LEO participating in a hand to hand transaction of a drug sale/handoff.
  • An individual is observed wearing a mask or face covering and is observable from a public or government space. (Mask Law)

2.5. Property Searches

  1. LEO’s have the right to conduct a search (home raid) on an individual’s property if after conducting investigations they have met the at least 3 of the following criteria: 
  • Individuals have been observed running in and out of the houses during/after shootouts and/or selling drugs. 
  • The homeowner is caught with firearms that are not licensed to them on more than 3 occasions. 
  • The home owner is arrested for drug trafficking.
  • The homeowner has been found with illegal substances on more than 5 occasions. 
  1. An individual who is found with any LEO equipment under officers discretion are subject to having their home searched for any other Law Enforcement equipment. 

2.6. Police Processing

  1. LEOs must make every effort to contact a lawyer if an individual is being charged with at least 1 Misdemeanor or 1 Felony.
  2. LEOs are only obligated to wait no longer than 10 mins for a Lawyer.
  3. Civilians will have the option to plead guilty or not guilty to their charges when being processed. 

3.a – If pleading Guilty, you will be charged as per normal and do time but you will not be able to appeal the charges in court.

3.b – If pleading Not Guilty, you will still be charged as per normal and do time, but you will be able to seek out a lawyer to appeal the charges. (Appeals must be submitted with the Courts, via a Lawyer, within 2 weeks of the charge.)

  1. LEOs must offer an individual the chance to pay their ticket.
  2. LEOs must offer an individual the chance to respond to their charges.
  3. LEOs must present or read out what the individual is being charged with before they are issued with a ticket and/or jail time.
  4. When an individual is being processed and sent to prison, LEOs will confiscate the following  items
  • Any illegal items 
  • All weapons 
  • Any items that have been obtained in the commission of a crime
  1. LEOs will be able to reduce time/fines, amount determined by their rank, and/or if working with a Lawyer

2.7. License seizing

  1. If an individual is charged with at least one of the following charges, LEO’s may use their discretion to seize an individual’s Driver License.
  • DUI/DUI with Bodily Harm
  • Hijacking
  • Felony Evasion
  • Felony Grand Theft Auto
  • Vehicular Manslaughter
  1. If an individual is charged with two of the following charges, LEO’s may use their discretion to seize an individual’s Weapons Licence.
  • Gang Violence
  • Aggravated Robbery
  • Aggravated Assault
  • Murder
  • Any Capital Crime

2.8. Vehicle Impounding

  1. LEO’s may impound a vehicle with a charge of up to $10000 at their discretion if the owner of the involved is charged with any of the following:
  • DUI/DUI with Bodily Harm
  • Hijacking
  • Felony Evasion
  • Felony Grand Theft Auto
  • Vehicular Manslaughter
  1. Vehicles are subject to a 1 hour – 4 hours impound when caught committing the following:
  • Felony Evasion
  • Hit and Run 
  • Reckless driving
  • Street Racing
  1. Vehicles are subject to a 4 hours – 1 day impound when caught committing the following:
  • The driver commits multiple felony evasions multiple times in one day with the same vehicle. (If officers have tagged the vehicle for felony evasion and it is caught after the initial evasion this standard still applies.)
  • The driver is arrested for DUI.
  1. Vehicles are subject to a 1 day – 4 day impound when caught committing the following:
  • The driver has had the vehicle impounded for an extended amount of time in the last week and is caught. 
  • If the vehicle is abandoned mid chase for a car swap or is used as the car swap vehicle. 
  • The driver commits vehicular manslaughter or causes any type of bodily harm to anyone with the vehicle. 
  • The driver is excessively reckless with the vehicle and sends the vehicle off excessively high ramps. 
  • The vehicle is known to continuously interfere with police chases, on 2 or more occasions.
  1. Vehicles are subject to a 4 day – 7 day impound/seizure when caught committing the following:
  • Multiple counts of vehicular manslaughter with the same vehicle. . 
  • Ramping the vehicle off cliffs. 
  • The vehicle is used for drug trafficking more than twice
  • The vehicle is driven into a body of water intentionally during a police pursuit.

Anyone driving the vehicle that is a known accomplice of the owner of the vehicle committing any of the aforementioned crimes the vehicle is subject to the same penalties.
